1.General
1.1. The rental contract is between the Hirer, named in the booking form below and Anlim Investments doo (operating as Sunset Properties Croatia (SPC)). The apartment is to be occupied for private use only. It cannot be sublet. The apartment can only be occupied by those persons whose names are disclosed on the Booking Form. Any changes to the intended occupants must be notified to SPC by letter, fax or email.
1.2. The Hirer warrants that he/she has the authority to accept these Conditions on behalf of the entire party listed on the Booking Form (including those substituted or added at a later date) and is responsible for ensuring that each member of the party is informed of and complies with the Terms and Conditions of the booking.
1.3 SPC is not responsible for minor changes in the facilities described.
1.4 Pets are not allowed.
1.5. This contract will be governed by Irish Law
2. Payment
A 25% deposit is payable on booking. The balance of the full payment is due 8 weeks prior to the first day of occupancy. Unless otherwise agreed payment should be made to “Anlim Investments Doo” in euro in accordance with the payment instructions at the foot of the Booking Form.
3. Cancellation
Notification to cancel must be made by letter, email of fax to SPC and the date of cancellation is the date at which SPC receives the notification.
The following cancellation charges apply:-
Up to 8 weeks prior to date of occupancy: deposit only.
4-8 weeks prior to occupancy: 75% of full payment.
less than 4 weeks prior to occupancy: 95% of full payment.
4. Damages and breakages
The Hirer is liable for the replacement or repair cost resulting from any damage or breakages caused. In certain circumstances a damage deposit may be required. The apartment should be vacated in the same state of repair and cleanliness as it was found.
5. Behaviour
All members of the party must behave appropriately having regard to the Villa location and the impact of noise on neighbours. SPC reserves the right to terminate the booking with immediate effect without compensation if the behavior of any individuals within the party is inappropriate, offensive or causing danger to others.
6. Arrival and departure
All bookings are from Saturday to Saturday for periods of one or more weeks unless otherwise agreed
by SPC. The apartment must be vacated by 10.00am on the day of departure and arrival should not be before 4.00pm unless alterations to these arrangements have been agreed.
7. Liability
The amenities of the property shall be used entirely at the Hirer’s own risk. SPC is not responsible for the loss or damage to any valuables belonging to the occupants of the apartment. SPC is not responsible for the death or injury of any person occupying the apartment or using the apartment, garden or pool. Diving in the pool is not permitted. Occupants are advised to take care whilst walking with wet feet on stone, tile or marble surfaces that may be slippery.
8. Right of entry
SPC or its agents have right of entry to the Villa at any time to carry out inspections, make repairs or attend to the garden and pool.
9. Booking
Booking is made at the point when SPC receives the payment of a deposit. SPC reserves the right to cancel the booking at any time in which case a full refund will be made of any monies paid (other than cancellations resulting from inappropriate behaviour as set out in clause 5 above in which case no refund will be paid).
